1. Nature of Services & Open Portability

DockSpin provides managed Linux web hosting infrastructure, containerized control planes, automated SSL certificates via Let's Encrypt, DNS routing interfaces, and database orchestration for WordPress, Laravel, PHP, and static web applications.

Our services are architected around platform neutrality and customer data sovereignty. Customers retain full, unfettered ownership of their domain names, files, databases, and application code. All paid plans provide 1-click 'Take My Site' open-format export tools (standard SQL dumps, configuration files, and unencrypted file archives) with zero proprietary vendor lock-in.

2. Service Availability & Warranty Disclaimer

Services are provided strictly on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

While DockSpin employs automated self-healing monitoring, daily snapshot engines, and enterprise transit infrastructure, Pioneer Ventures Technology does not warrant that services will be uninterrupted, error-free, completely secure, or immune from third-party upstream carrier outages, DDoS attacks, optical fiber disruptions, or transit latency spikes.

3. Exclusion of Liability for Application-Layer & Third-Party Code

DockSpin manages infrastructure and server orchestration. You, as the Customer, retain full responsibility for the security, compatibility, and functioning of all application-layer software deployed to your sites.

To the maximum extent permitted by applicable law, Pioneer Ventures Technology and DockSpin disclaim all liability for any downtime, security compromise, database corruption, or financial losses caused by: (a) customer-installed WordPress plugins, third-party themes, or unpatched CMS scripts; (b) custom PHP, Laravel, or JavaScript code deployed via Git, SFTP, or manual upload; (c) customer misconfiguration of DNS records, .htaccess rules, or environment secrets; or (d) compromised customer credentials.

4. Customer Backup Responsibility & Data Sovereignty

DockSpin provides automated snapshot utilities and native personal Google Drive offsite synchronization. However, maintaining offsite disaster recovery backups remains the Customer's ultimate operational responsibility.

Customers are strongly advised to verify snapshot health and test recovery procedures regularly. Pioneer Ventures Technology disclaims liability for data loss resulting from hardware catastrophic events, customer accidental deletion, or third-party cloud storage API disruptions.

5. Zero Data Mining, Content Non-Inspection & Customer-Owned Vault Covenant

Pioneer Ventures Technology and DockSpin contractually guarantee that we will never scan, inspect, index, harvest, or commercialize customer database records, application code, customer orders, or private communications, nor use customer data to train artificial intelligence (AI) or machine learning models.

Offsite backups synchronized to customer-connected Google Drive repositories are encrypted client-side via Restic using customer-designated encryption keys. DockSpin maintains zero custody, commercial visibility, or retention rights over customer offsite storage repositories. We run the infrastructure engine; you hold the keys to your sovereign data vault.

6. Limitation of Financial Liability

To the maximum extent permitted by applicable law, in no event shall Pioneer Ventures Technology, DockSpin, or its directors, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of business profits, data loss, business interruption, or goodwill), regardless of the cause of action or legal theory.

Under all circumstances, the total aggregate liability of Pioneer Ventures Technology and DockSpin arising out of or relating to these Terms or the Services shall not exceed the total fees actually paid by the Customer to DockSpin in the three (3) months immediately preceding the event giving rise to liability.

7. Customer Indemnification

Customer agrees to defend, indemnify, and hold harmless Pioneer Ventures Technology, DockSpin, and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, losses, damages, judgments, penalties, costs, and expenses (including reasonable legal and attorneys' fees) arising out of or related to: (a) customer's access to or use of the Services; (b) any website content, files, databases, media, or applications hosted, published, or transmitted through customer's sites; (c) customer's infringement or violation of any third-party intellectual property, privacy, publicity, or statutory rights; or (d) customer's breach of these Terms, the Acceptable Use Policy, or applicable laws.

8. Acceptable Use Policy (AUP) & Immediate Suspension

You agree not to use DockSpin infrastructure to host, transmit, or distribute: (a) malware, ransomware, botnets, or phishing campaigns; (b) unsolicited bulk commercial email (spam) or open mail relays; (c) copyright-infringing material or unauthorized intellectual property; or (d) any material in violation of Hong Kong Special Administrative Region laws or international regulations.

Pioneer Ventures Technology reserves the right to suspend or terminate any account or workload immediately upon discovering severe AUP violations, without prior notice, liability, or refund.

9. Billing, Quotas & Cancellation

DockSpin plans (Starter $9/mo, Business $29/mo, Pro $49/mo) are billed monthly in USD at checkout. Storage, bandwidth, and mailbox quotas are enforced according to the active plan specification.

Customers may cancel their subscription at any time directly in the customer portal or billing dashboard prior to the upcoming renewal date. No cancellation fees apply.

10. Third-Party Integrations & Upstream Providers

DockSpin incorporates third-party software, open-source utilities, and upstream infrastructure providers (including OpenLiteSpeed, MariaDB, Let's Encrypt, Cloudflare, Google Drive, Stripe, and PayPal). Pioneer Ventures Technology makes no warranties regarding such third-party services and disclaims liability for upstream service disruptions, API modifications, or policy shifts.

11. Force Majeure

Neither party (with the exception of customer's payment obligations) shall be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, extreme weather, warfare, terrorism, civil unrest, labor disputes, telecommunication or power grid failures, optical fiber cuts, upstream ISP transit disruptions, or distributed denial-of-service (DDoS) attacks.

12. Governing Law & Exclusive Jurisdiction

These Terms of Service and any disputes arising out of or related to DockSpin shall be governed by, interpreted, and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR), without giving effect to any conflict of law principles.

Any legal action, suit, or proceeding arising under these Terms shall be instituted exclusively in the courts of the Hong Kong Special Administrative Region.

13. Language Prevalence, Severability & Entire Agreement

Prevalence of English Language: These Terms are drafted and executed in the English language. In the event of any conflict, discrepancy, inconsistency, or ambiguity between the English text and any translation in Chinese (Traditional or Simplified) or any other language, the English version shall prevail and govern in all legal respects.

Severability & Non-Waiver: If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, and all remaining provisions shall continue in full force and effect. No failure to enforce any right shall constitute a waiver of any subsequent breach.

Entire Agreement: These Terms of Service represent the entire understanding between Customer and Pioneer Ventures Technology concerning the Services and supersede all prior negotiations, representations, or agreements.
